1. EXEMPTION STATEMENT
All visual depictions displayed on FansCritic, whether of actual sexually explicit conduct, simulated sexual content, or otherwise, are exempt from 18 U.S.C. § 2257 and 28 C.F.R. § 75 record-keeping requirements on one or more of the following grounds:
- The visual depictions appearing on or referenced through the Service do not portray conduct as specifically listed in 18 U.S.C. § 2257(h)(1) as amended
- The visual depictions were created prior to July 3, 1995
- The visual depictions are not produced, manufactured, published, duplicated, reproduced, or reissued by FansCritic, and are therefore not subject to the record-keeping provisions of 18 U.S.C. § 2257
2. THIRD-PARTY CONTENT
FansCritic is an independent review and discovery platform. We do not produce, host, upload, or distribute any sexually explicit visual content.
Any visual depictions of adult content accessible through the Service appear on third-party platforms (such as OnlyFans) operated by independent producers and publishers. Those third parties are responsible for maintaining all records required by 18 U.S.C. § 2257, and inquiries regarding such records should be directed to the original publisher of the content.
3. NO PRODUCTION ROLE
With respect to all visual depictions displayed on the Service, whether linked or referenced from third-party platforms, FansCritic is not the "producer," as defined by 18 U.S.C. § 2257(h)(3), of any such visual depictions. More specifically:
- FansCritic does not create, produce, or modify visual content
- FansCritic does not manage or direct the content of any third-party platform
- FansCritic has no role in selecting, hiring, contracting, managing, arranging for, procuring, or otherwise facilitating the actual performance or sexually explicit conduct of any performer depicted on third-party platforms
