1. OVERVIEW
FansCritic respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to notices of alleged copyright infringement that are reported to our Designated Copyright Agent.
2. REPORTING COPYRIGHT INFRINGEMENT
If you believe that content made available through the Service infringes your copyright, you may submit a written notification to our Designated Copyright Agent containing the following information, as required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed, or, if multiple works are covered by a single notification, a representative list of such works
- Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate it, such as the exact URL on the Service
- Your contact information, including your full legal name, address, telephone number, and email address
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on their behalf
Incomplete notifications may not be actionable.
3. SUBMITTING A NOTICE
Submit DMCA notices through our Contact page or directly to our Designated Copyright Agent at the contact provided there.
4. COUNTER-NOTIFICATION
If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notification containing:
- Your physical or electronic signature
- Identification of the material that was removed and the location at which it appeared before removal
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed as a result of mistake or misidentification
- Your full legal name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which FansCritic may be found), and that you will accept service of process from the person who submitted the original notice
5. REPEAT INFRINGERS
In accordance with the DMCA and applicable law, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, accounts of users who are deemed to be repeat infringers.
6. MISREPRESENTATIONS
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be liable for damages.
